EVENT WAIVER

This Waiver and Release of Liability (the “Waiver”) is a binding legal agreement between you, the participant (“Participant,” “I,” or “me”), and Hózhó Path Renewal, a nonprofit organization (the “Organizer”), governing my participation in the We Run For Them 5K (the “Event”) on Thursday, November 26, 2026, including any associated packet pickup, training, virtual participation, or related activity.

Please read each section carefully. By checking the box that says “I accept the event waiver” during online registration, I agree to all of the terms below. If I do not agree, I should not register and should not participate.

1. Acknowledgment of risk

I understand that participating in a 5K run or walk involves physical exertion and carries inherent risks that no amount of care, caution, instruction, or expertise can entirely eliminate. These risks include, but are not limited to:

  • physical injury, including muscle strains, sprains, fractures, blisters, dehydration, heat illness, hypothermia, and cardiac events;
  • collisions with other participants, spectators, vehicles, animals, or fixed objects;
  • conditions of the road, trail, sidewalk, or course surface, including uneven terrain, debris, and adverse traffic;
  • weather, including extreme temperatures, precipitation, wind, ice, snow, and lightning;
  • the acts or omissions of other participants, volunteers, sponsors, vehicle operators, and members of the public;
  • exposure to communicable disease;
  • and, in rare cases, serious or permanent injury, disability, or death.

I represent that I am in sufficient physical condition to participate, that I am not aware of any medical condition that should prevent my participation, and that I have consulted a qualified physician if I have any doubt. I assume full and personal responsibility for any injury, loss, or damage I may suffer in connection with the Event, including injuries arising from my own negligence or the ordinary negligence of the Released Parties (defined below).

2. Release and waiver of liability

In consideration of being permitted to participate in the Event, I — for myself, my spouse, my children, my heirs, executors, administrators, and assigns — hereby release, waive, discharge, and covenant not to sue Hózhó Path Renewal, the Event organizers and co-organizers, the Event sponsors, the Event volunteers, contractors, and staff, the host cities and communities, the property owners on whose land any portion of the Event is held, and all of their respective officers, directors, employees, agents, successors, and assigns (collectively, the “Released Parties”) from any and all claims, demands, liabilities, damages, costs, or expenses of any kind — including, without limitation, those for personal injury, illness, death, or property damage — arising out of or in any way related to my participation in the Event, even where such claims arise from the negligence of any Released Party. This release is intended to be as broad and inclusive as permitted by applicable law.

3. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, demands, judgments, losses, costs, and expenses — including reasonable attorneys’ fees — brought by me, by anyone claiming through me, or by any third party arising from my participation in the Event, my conduct in connection with the Event, or any breach of this Waiver.

4. Medical-emergency authorization

In the event of illness, injury, or medical emergency, I authorize Event personnel, medical staff, and emergency responders to administer first aid and to obtain any further medical care, hospitalization, or transport they deem advisable on my behalf. I agree to be responsible for the cost of any such care. The Organizer is not responsible for the cost, quality, or outcome of any medical treatment provided to me.

5. Photography, video, and media release

I grant the Organizer and its authorized representatives an irrevocable, perpetual, royalty-free, worldwide license to record, photograph, broadcast, stream, and publish my name, voice, image, likeness, and any photographs, audio, or video of me taken in connection with the Event, for the Organizer’s educational, promotional, fundraising, advocacy, and historical purposes, in any medium now known or hereafter developed. I waive any right to inspect or approve the finished product, and I understand that I will not receive compensation for any such use.

6. Rules and conduct

I agree to follow all Event rules, posted instructions, signage, and the directions of Event officials, volunteers, and law-enforcement personnel, including but not limited to the following:

  • starting only at the time and from the location assigned to me by the Organizer;
  • wearing my assigned bib visibly on the front of my outermost garment for the duration of the Event;
  • staying on the marked course and not cutting between course segments;
  • yielding to emergency vehicles, faster runners on shared course sections, and pedestrians who are not Event participants;
  • refraining from harassment, discriminatory conduct, intoxication, profanity, or any behavior that endangers myself or others;
  • not bringing weapons, controlled substances, fireworks, glass containers, hazardous materials, or unauthorized vehicles onto the course or to packet pickup;
  • respecting the lands, communities, and peoples that host the run; and
  • leaving the course immediately if asked to do so by an Event official.

The Organizer reserves the right to refuse participation to, or remove from the course, any individual whose conduct presents a safety, security, or community-relations concern, without refund.

7. Bib, runner number, and personal property

My bib and runner number are issued to me alone and are not transferable. Selling, giving, swapping, or otherwise transferring a bib or runner number to another individual is grounds for disqualification and may result in being barred from future Events. The Organizer is not responsible for lost, stolen, or damaged personal property at the Event, at packet pickup, on the course, or in transit.

8. Entry fee, refunds, transfers, and cancellation

My entry fee supports the programs and advocacy of Hózhó Path Renewal and is non-refundable, except where a refund is required by applicable law. Entries are non-transferable between participants. The Event may be modified, postponed, relocated, shortened, converted to a virtual format, or canceled, in whole or in part, due to weather, course conditions, public-health requirements, government action, war, civil unrest, fire, flood, earthquake, pandemic, terrorism, or any other cause beyond the Organizer’s reasonable control (each, a “Force Majeure”). In any such case, the Organizer will use commercially reasonable efforts to offer a virtual alternative or to honor my registration for a future Event, but no refund is guaranteed.

9. Age and parental or guardian consent

Participants must be at least twelve (12) years of age on race day. If the Participant is under eighteen (18) years of age, a parent or legal guardian must read, accept, and complete this Waiver on the Participant’s behalf. By doing so, the parent or legal guardian accepts every term of this Waiver personally and on behalf of the minor Participant, including the release of liability and the indemnification obligations.

10. Privacy

By registering, I consent to the Organizer collecting, storing, and processing the personal information I provide for the purposes of administering my entry, providing race-day support, and, if I have opted in, sending future updates from the Organizer. I may unsubscribe from updates at any time using the link in any update email. The Organizer does not sell personal information to third parties.

11. Governing law and venue

This Waiver shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to this Waiver or to the Event shall be resolved exclusively in the state or federal courts located in [County], New Mexico, and I consent to the personal jurisdiction of those courts.

12. Severability

If any provision of this Waiver is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any respect, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.

13. Entire agreement

This Waiver, together with the rules and instructions provided by the Organizer at registration and on race day, constitutes the entire agreement between me and the Organizer with respect to my participation in the Event, and supersedes all prior oral or written agreements between the parties on the subject matter.

14. Acceptance

By checking “I accept the event waiver” during registration, I confirm that I have carefully read this entire Waiver and Release of Liability, understand its terms, and accept them freely and voluntarily, without inducement or coercion. I am at least eighteen (18) years old or, if I am not, a parent or legal guardian has accepted these terms on my behalf.
